Australia Student Visa Changes from 2 October 2026: What Indian Students Need to Know
If Australia is on your study-abroad shortlist, there is an important update to understand before paying a deposit or making travel plans.
From 2 October 2026, Australia changed the rules around applying for Student and Student Guardian visas while in Australia and including family members in Student visa applications.
You can still apply to study in Australia if you meet the requirements. The practical questions are now: where must you apply, and can your family be included?
Can you take your spouse or children?
Most new Student visa applicants can no longer include their partner or dependent children unless an exemption applies. The restriction also covers further Student visa applications.
Limited exemptions include doctoral students, DFAT or Defence-sponsored students, fully funded foreign-government scholarship recipients and eligible Pacific or ASEAN nationals.
Where family members qualify, the student and included family members must all be in Australia or all outside Australia when lodging.
You cannot add family members later through a subsequent-entrant Student visa application under the new rules, even if an exemption allows inclusion in the initial application.
For a married applicant, this makes family planning an early decision. Do not assume you can travel first and arrange a dependent application later.
What about families already in Australia?
There are transitional arrangements for some existing families. Home Affairs explains that family members already included on current Student visas may be eligible for inclusion in a further application lodged in Australia.
Additional provisions cover some existing family members where the student needs up to 12 more months to finish the main course or has been affected by education-provider default. The conditions must be checked individually.
This is why a new applicant and a student already living in Australia with family should not rely on the same advice.
Can you apply while you are in Australia?
Most affected temporary visa holders must now be outside Australia both when applying for a Student or Student Guardian visa and when it is granted.
Current Student visa holders also generally need to apply for their next Student visa offshore unless an exemption applies. These changes do not cancel their current visa.
A Student visa dependant applying to become the primary student must apply offshore and be offshore at grant; Home Affairs states there are no exemptions to that rule.
Current Student Guardian visa holders can continue applying for another Student Guardian visa in Australia.
Which current students may qualify for an onshore exemption?
Home Affairs identifies limited circumstances, including:
- Needing up to 12 additional months to complete the main course with the same provider.
- DFAT or Defence sponsorship.
- Applying for doctoral, primary or secondary school studies.
- Completing the main course and progressing to a higher Australian Qualifications Framework (AQF) level.
- Certain progression from school or courses without an AQF level.
- Being unable to continue because the education provider has defaulted.
The detailed conditions matter. For example, after completing a higher-education course, the proposed higher-level course must also be higher education delivered by a higher-education provider. A new offer alone does not establish eligibility.
What happens if you apply from the wrong location?
Home Affairs warns that an onshore application is invalid if you are required to apply offshore. Including an ineligible family member makes that person's application invalid.
An offshore application does not provide a linked Bridging visa. Although you may return on another valid visa during processing, you must be outside Australia at grant if the offshore requirement applies.
Before booking travel, check your current visa expiry, the intended intake and the time needed for processing. Build the application location into your study plan rather than treating it as a last-minute detail.
What if you applied before 2 October 2026?
Student visa applications lodged before 2 October 2026, including those with family members, continue to be assessed under the rules in place when lodged.
Keep the application acknowledgement showing your lodgement date. An admission offer date or a draft application is not the same as the date a visa application was lodged.
What should Indian students do now?
If you are applying from India, begin by reviewing your course choice, documents and family arrangements together. If you are already in Australia, also review whether your next application can be lodged there.
Before making commitments, answer these questions:
- Are you applying alone or hoping to include family?
- What visa do you currently hold, and when does it expire?
- Does a specific exemption apply to your proposed course and circumstances?
- If you must apply offshore, how will travel and processing affect your intake?
Prepare your documents early and check the current Home Affairs instructions before submission.
